General Terms & Conditions – B2B & B2C Clients

  1. Overview & Agreement to Terms

    These General Terms & Conditions ("Terms") govern all services provided by Dream Urlaub GMBH (“Dream Urlaub”, “we”, “us”, “our”) to both business clients (B2B) and individual consumers (B2C).

    By accessing our website, using our booking platforms (including back office, API, affiliate systems), or completing a reservation, you agree to be bound by these Terms. If you do not agree, you may not use our services.
  2. Client Classification

    B2C (Individual Travelers): Any natural person booking services for personal use.

    B2B (Corporate/Agency Clients): Legal entities, companies, or resellers using Dream Urlaub services to fulfill client bookings or for business travel purposes.

    Each group is subject to certain shared and certain specific provisions outlined in this agreement.
  3. Registration & Access

    B2B Clients

    • Must submit complete and accurate business registration details.
    • Must designate a responsible contact person authorized to act on behalf of the company.
    • Must not share login credentials or access with unauthorized third parties.

    B2C Clients

    • Must be at least 18 years of age and have full legal capacity.
    • All information provided at booking must be accurate and verifiable.
    • Use of the site for commercial or resale purposes is strictly prohibited.

    Dream Urlaub GMBH reserves the right to suspend or terminate any account in case of suspected fraud, abuse, or false information.
  4. Services Provided

    Dream Urlaub GMBH acts as a travel consolidator and intermediary for:

    • Flights, hotels, airport transfers, car rentals, tours, travel packages, and related services
    • Online booking platforms (via website, API, or affiliate tools)
    • White-label and net-rate booking engines for B2B partners

    Service confirmation is effective only after issuance of official travel documents (e.g., e-tickets, vouchers).
  5. Booking Process & Binding Agreement

    A booking becomes legally binding when:

    • The client completes a transaction via our platform or confirms a quotation; and
    • A booking confirmation is issued by Dream Urlaub GMBH

    B2B and B2C clients are both bound to supplier-specific cancellation, change, and refund policies available at booking.
  6. Payments & Financial Terms
    1. Payment Methods

      All bookings must be prepaid using one of the following accepted methods:

      • Bank transfer
      • Credit card (Visa, MasterCard in EUR/USD)
      • Wallet balance (for B2B accounts)
    2. Currency & Charges

      Prices are displayed in EUR or USD unless otherwise stated.
      Foreign exchange fees, bank charges, or card processing fees are the responsibility of the client.
    3. Refunds & Cancellations

      Refunds for eligible cancellations will be credited to the client’s wallet or original payment method (as applicable).

      Chargebacks are strictly prohibited after confirmed service delivery, unless legally required.

      Administrative fees may apply to changes or cancellations, in addition to supplier penalties.
  7. B2B-Specific Financial Terms

    Invoices must be paid by the due date. Late payments may result in:

    • Booking cancellation
    • Interest charges
    • Suspension of account access

    Repeated non-payment or chargeback abuse will result in blacklisting and legal action.

    Wallet balances are non-transferable and non-refundable unless agreed in writing.
  8. Travel Documents & Entry Requirements

    The client is solely responsible for ensuring:

    • All passengers possess valid passports, visas, and required documents
    • Compliance with COVID-19 or health regulations applicable to each destination
    • Arrival at the correct time and place of departure

    Dream Urlaub GMBH is not responsible for missed services, denied boarding, or entry refusals due to documentation issues.
  9. Platform Use & Intellectual Property

    All content, booking tools, software, XML/API interfaces, and designs are the intellectual property of Dream Urlaub GMBH.

    You may not:

    • Reproduce, modify, or distribute system content
    • Use scraping tools, bots, or automation
    • Reverse engineer or manipulate system code

    Breach of these rules may lead to civil and criminal prosecution under Austrian and international law.
  10. Misuse, Fraud & Account Termination

    Dream Urlaub GMBH actively monitors for misuse and reserves the right to:

    • Block any transaction suspected of fraud
    • Request ID or documentation verification
    • Suspend or terminate accounts without notice in cases of:
      • Fake bookings
      • Unauthorized reseller activity (B2C)
      • Stolen credit card use
      • Repeated policy violations

    Legal action may be taken in cases of severe misuse or damages.
  11. Third-Party Terms and Liability

    Travel services are often fulfilled by independent third-party providers. Therefore:

    • Dream Urlaub GMBH is not liable for delays, loss, overbooking, cancellations, or quality issues caused by suppliers.
    • The client agrees to comply with the individual supplier’s terms (airlines, hotels, car rental companies, etc.).
    • Any complaints related to third-party services must be directed to the supplier.
  12. Liability Limitations

    To the extent permitted by law:

    • Dream Urlaub GMBH shall not be liable for indirect, incidental, or consequential damages arising from the use of our services.
    • Our maximum liability is limited to the total value of the affected booking.
  13. Invoicing & Dispute Procedure

    Invoices must be paid within the period indicated (or immediately if no term is stated).

    Any invoicing discrepancies must be reported in writing within five (5) calendar days.

    Failure to dispute an invoice within this time constitutes full acceptance.
  14. Governing Law & Jurisdiction

    These Terms are governed by the laws of the Republic of Austria.
    All unresolved disputes shall be referred to arbitration in Vienna, under Austrian commercial law.

    For B2C clients located within the EU, consumer protection rules under Regulation (EU) No 524/2013 (ODR platform) may apply.
  15. Privacy & Data Protection

    All data processing is carried out in compliance with the EU General Data Protection Regulation (GDPR).
    Clients may view our full Privacy Notice and Cookie Policy on our website.
    Dream Urlaub does not store full cardholder data and uses SSL encryption and PCI DSS–compliant processors for secure transactions.
